Instead of a “conviction,” juveniles in Minnesota are typically deemed “delinquent” when they are found guilty or admit guilt to having committed what would be a crime if committed by an adult. Unlike adult court, where the prosecutor’s goal is typically to secure punishment for having committed a crime, the goal in juvenile court is rehabilitation of the child. At least that’s how it’s supposed to be.
This, of course, is not always how things shake out. Some prosecutors seek significant “sentences” for delinquent juveniles convicted of certain crimes. Depending on the age of the child, the child’s case can continue through their 21st birthday, despite that they are legally an adult at age 18 (through “EJJ” or “Extended Jurisdiction Juvenile” proceedings). Additionally, the consequences juveniles receive for a being found delinquent can carry over long into adulthood. This includes criminal records that are publicly accessible, predatory offender registration obligations, public stigmas and reputational problems, and court and other records that may appear on background checks for jobs and housing forever. Constitutional rights—such as the second amendment’s right to bear arms—may also be compromised forever if a child is found delinquent.
