What is a misdemeanor?
In Minnesota, there are three categories of misdemeanor offenses: Petty misdemeanors, misdemeanors, and gross misdemeanors. Petty misdemeanors are the lowest category, misdemeanors are in the middle, and gross misdemeanors are the most serious.
Petty Misdemeanors carry a maximum penalty of up to a $300 fine, and cannot involve a jail sentence. However, they can have significant collateral consequences, including impacts on driving privilege/driver’s licenses like a license suspension.
Misdemeanors can carry sentences of up to 90 days in jail and/or a $1,000.00 fine. Misdemeanors can be tried to a jury of six. Common examples include low-level, first-time DWI or DUI offenses, trespassing, and disorderly conduct.
Gross Misdemeanors can carry sentences of up to one year in jail and/or $3,000.00 fine. Like misdemeanors, they can be tried to a jury of six. Common examples include second-time DWI offenses, high-test DWI offenses or Test Refusals, interference with a 911 call, and furnishing alcohol to a minor.
